This is VERY interesting...
It appears that Alan Gottlieb might just have pulled a fast one. For starters Alan Gottlieb is the man that got Chicago's handgun ban thrown out in McDonald v. Chicago.
I heard Alan on Gun Talk today on the radio talking about this, it turns out they invited themselves to the table and wrote the legislation. The way it is currently crafted, this could end up being a net win for gun owners. We give up the "gun show loophole" which if you know anything about how gun shows work there really is no such thing... it is a made up term and almost all firearms sold at a gun show already go through an NICS check. We also give up "internet sales" which once again, if you have any clue on how this works, almost all internet sales already have to go through an FFL with a NICS check. So basically gun owners give up very little. Most private face to face sales are protected from needing a background check. It also Clarifies that submissions of mental health records into the NICS system are not prohibited by federal privacy laws (HIPAA), something I don't think anyone would have an issue with.
Here is what we get in return...
We gain the ability to purchase handguns across state lines.
We gain protections for transporting firearms across state lines.
We gain the right for FFL dealers to conduct business outside of their home state.
If you currently have a concealed weapons permit you no longer have to do a background check to purchase a firearm.
There are protection for veterans written into the bill.
We get tort immunity for any gun we sell through an FFL... this is HUGE. As it stands right now if I sell a gun to a guy and he then uses that gun to rob a bank I can be sued by the victim, even if the guy passes a background check.
And last but not least we finally get a law that 100% forbids anyone from misusing any kinds of records kept, including creating a registry... if they do misuse the data they face a 15 year prison term.
So basically what they have done is created a bill that if the Dem's don't support they are against stronger gun control, if they do support it they are signing on to increasing gun rights... so they are fucked if they do and fucked if they don't...
